Governing Documents

This section provides essential information regarding our governing structures as Abbey Road Condominium Trust, including information on budget procedures, finances, insurance, and the Trustee role in management.

Here you will find a summary explanation of and links to the complete texts of these major governing documents: Master Deed & Declaration of Trust. These documents define the legal structure and ownership of our community as well as defining the rules and regulations of our condominium association. The goal is to ensure that every one of us can enjoy living here harmoniously, governed by courtesy, common sense, and safety.

The Master Deed P.6

The Master Deed is the legal basis for the creation and management of Abbey Road Condominium Trust.  December 21, 2016. Abbey Road Development LLC “does hereby create by this Master Deed, with respect to the Property (land, buildings, and improvements) a condominium, to be governed by and subject to the provisions of this Act (MGL183A) “. 

 

The reference to MGL 183A is to the Massachusetts law setting basic rules and standards for condominiums in the State.

 

Here are a few selections of what is covered in the Master Deed. 

Article VI of the Master Deed (pages 7-10) entitled “Use of the Buildings, Units and Common Elements”, commonly referred to as rules and regulations.  It covers many topics, such as preserving the architectural integrity of Abbey Road from unapproved additions or changes, pets, cleanliness, noise and rules regarding porches and patios.

 

Section 6.4 on pages 14-15, has especially valuable information on the water systems at Abbey Road. Read more on this under section 6.1cc in the Declaration of Trust.

 

Declaration of Trust

The Abbey Road Condominium Trust organization of unit owners was created by the Declaration of Trust, empowering unit owners to manage and regulate the condominium association. This 38-page document was enacted by and for the Abbey Road Condominium Trust, and all owners are beneficiaries of the Trust, while Trustees are given the authority to manage and administer for the benefit of the owners.

 

Article VI is entitled By-Laws

It contains the organization of and bylaws for the Trust as it applies to the premises of the condominium, the Trust property and to the use and occupancy thereof. Beginning with section 6.1, entitled Powers and Duties of Trustees, you can read about budgets, managing common areas, contracting and maintaining. Section 6.1 (p.9) covers the Powers and Duties of Trustees, including operations, maintenance, and finances of Abbey Road.

In Section 6.1cc what is clearly stated as NOT under the management of the Trustees are the three water systems. The issue of the water systems is so important it is included at length in both the Master deed and the Declaration of Trust, section 6.1cc (p.13).  Essential to read the pages on water.

 

Section 6.2 regards maintaining and repairing owner units which is a divided responsibility.

Section 6.3 regards maintaining and repairing the common areas.

Section 6.5 regards finance, assessments, and reserves.

Section 6.5 regards insurance.
